II. Categories of Processed Personal Data

II.1. If you are a customer of the Site, Iepan Dorela will process your personal data, such as name, phone number, email address, billing address, data regarding how you use the Site (e.g., behavior/preferences/habits within the Site), and any other categories of data you provide directly when creating a user account, placing an order through the site, booking a session, or in any other way resulting from the use of the Site.

If you take part in sessions, coaching or programs, you may choose to share information about your health and your emotional state. This is special-category data and is processed only as described in section III.1.

If you choose to create a user account on the Site using your Facebook or Google account, Iepan Dorela will process the following public profile data displayed by the respective applications: username, email address.

If you choose to create a user account only before completing an order for a product available on the Site, your email address will be requested, and an account will be automatically created based on it. If you do not complete the order, the email address and other provided data will not be stored by Iepan Dorela, and the created account will be automatically deleted.

II.2. If you are a visitor to the Site, Iepan Dorela will process your personal data that you provide directly in the context of using the Site, such as data provided in the contact/questions/complaints section, to the extent that you contact us in this way, and data collected through cookies, according to your choices in the cookie banner (see the Cookies Policy).

II.3. Payments are processed by payment service providers (Stripe, PayPal). Your card details are entered on their secure pages and are not accessible to or stored by Iepan Dorela.

III. Purposes and Legal Bases for Processing

III.1. If you are a customer of the Site, Iepan Dorela processes your personal data for the following purposes:

• for the performance of the contractual relationship between you and Iepan Dorela, specifically for the acceptance, validation, access to products and services, and invoicing of the order placed on the Site, scheduling and carrying out sessions, informing you about the order status, etc.

Legal Basis: The processing of your data for this purpose is based on the contract between you and Iepan Dorela, as defined in the Terms and Conditions. Providing your personal data is necessary for the execution of this contract. Refusal to provide data may result in the impossibility of conducting contractual relationships between you and Iepan Dorela.

• for carrying out sessions, coaching and programs, taking into account the health-related information that you choose to share.

Legal Basis: your explicit consent (Article 9(2)(a) GDPR), given by ticking the relevant box in the service agreement or when booking. Sharing health information is voluntary, and you can withdraw your consent at any time, without affecting the processing carried out before the withdrawal.

• for the fulfillment of legal obligations incumbent upon Iepan Dorela in the context of services provided through the Site, including tax obligations, as well as archiving obligations.

Legal Basis: The processing of your data for this purpose is necessary based on legal obligations. Providing your data for this purpose is necessary. Refusal to provide data may result in Iepan Dorela’s inability to comply with its legal obligations and, therefore, unable to provide services through the Site.

• for marketing activities, namely for sending, through distance communication means (email, SMS), commercial communications regarding products and services offered by Iepan Dorela through the Site.

Legal Basis: The processing of your data for this purpose is based on your consent, if you choose to provide it. You can express your consent for data processing for this purpose by checking the corresponding box at the time of account creation or later, in the My Account section. To unsubscribe from receiving such commercial communications, you can use the option at the end of each email/SMS containing commercial communications. In addition, you can unsubscribe by accessing the My Account section. Providing your data for this purpose is voluntary. Refusing to provide consent for processing your data for this purpose will not have negative consequences for you.

• for statistics and reports on the functioning of the Site, mainly to improve the experience offered on the Site.

Legal Basis: your consent, given through the cookie banner, for analytics cookies and similar technologies; for data that does not use cookies, the legitimate interest of Iepan Dorela in continuously improving the customer experience on the Site. Providing your data for this purpose is voluntary. Refusing it will not have negative consequences for you.

III.2. If you are a visitor to the Site, Iepan Dorela processes your personal data as follows:

• for marketing activities, namely for sending, through distance communication means (email, SMS), commercial communications regarding products and services offered by Iepan Dorela through the Site.

Legal Basis: The processing of your data for this purpose is based on your consent, if you choose to provide it. You can express your consent for data processing for this purpose by completing and checking the corresponding box in the newsletter subscription form available on the Site. To unsubscribe from receiving such commercial communications, you can use the option at the end of each email/SMS containing commercial communications. Providing your data for this purpose is voluntary. Refusing to provide consent for processing your data for this purpose will not have negative consequences for you.

• for resolving complaints and grievances and for monitoring traffic to improve your experience on the Site.

Legal Basis: the legitimate interest of Iepan Dorela in ensuring the correct operation of the Site and improving the experience of Site visitors, including by addressing various comments, questions, or complaints; for analytics cookies, your consent. Providing your data for this purpose is voluntary. Refusing to provide data for this purpose will not have negative consequences for you.

IV. Duration of Data Processing

As a principle, Iepan Dorela will process your personal data for as long as necessary to achieve the processing purposes mentioned above.

If you are a customer, we will process your data for the entire duration of the contractual relationships and subsequently in accordance with the legal obligations of Iepan Dorela (e.g., in the case of accounting documents for which the legal retention period is 10 years).

If you are a customer and choose to delete your user account by pressing the Delete Account button in the My Account section, Iepan Dorela will interpret this action as your choice to unsubscribe from receiving commercial communications keeping you informed about the products and services offered through the site. In this sense, if you choose to delete your user account, we will no longer send you emails and/or SMS of this kind. However, we want to inform you that deleting the account will not automatically delete your personal data. If you want your personal data to no longer be processed or if you want your data to be deleted, you can exercise your rights detailed in section VII below. If you request the deletion of the account but there is at least one active order on that account, the account deletion request will only be recorded after the last active order is completed.

If you withdraw your consent for data processing for marketing purposes, Iepan Dorela will cease processing your personal data for this purpose, without affecting the processing carried out by Iepan Dorela based on the consent expressed by you before its withdrawal.

V. Disclosure of Personal Data

To fulfill the processing purposes, Iepan Dorela may disclose your data to partners, third parties, or entities that support Iepan Dorela in carrying out activities through the Site, acting as processors or independent controllers, such as: payment service providers (Stripe, PayPal); the email marketing platform (Newsman); the booking platform (UseAce); hosting and IT service providers; analytics and advertising providers (Google, Meta), according to your cookie choices; and to central/local public authorities, in the following exemplified cases:

• for the administration of the Site;
• in situations where this communication is necessary for the awarding of prizes or other benefits to data subjects, obtained as a result of their participation in various promotional campaigns organized by Iepan Dorela through the Site;
• for maintaining, customizing, and improving the Site and the services carried out through it;
• for data analysis, testing, and research, monitoring usage and activity trends, developing security features, and authenticating users;
• for sending marketing communications, within the limits and conditions provided by law;
• when the disclosure of personal data is provided by law, etc.

VI. Transfer of Personal Data

Personal data provided to Iepan Dorela is processed mainly within the European Economic Area. Some of our providers (for example Google, Meta, Stripe, PayPal) may transfer data outside the European Economic Area, including to the United States. In such cases, the transfer is made on the basis of an adequacy decision of the European Commission or of appropriate safeguards, such as the standard contractual clauses.

VII. Rights You Benefit From

In accordance with the legislation on the processing of personal data, as data subjects, you have the following rights:

• the right to be informed, namely the right to receive details regarding the processing activities carried out by Iepan Dorela, as described in this document;
• the right of access to data, namely the right to obtain confirmation from Iepan Dorela regarding the processing of personal data, as well as details regarding processing activities such as how data is processed, the purpose of processing, recipients or categories of data recipients, etc;
• the right to rectification, namely the right to obtain, without undue delay, the rectification by Iepan Dorela of inaccurate/unjustified personal data and the completion of incomplete data; Rectification/completion will be communicated to each recipient to whom the data was transmitted, except when this proves impossible or involves disproportionate effort.
• the right to erasure of data, without undue delay (“the right to be forgotten”), in case one of the following reasons applies:
  • they are no longer necessary for the purposes for which they were collected or processed;
  • in case consent is withdrawn, and there is no other legal basis for processing;
  • in case the data subject opposes the processing, and there are no legitimate reasons prevailing;
  • if personal data has been processed unlawfully;
  • if personal data must be deleted to comply with a legal obligation;
  • personal data has been collected in connection with the provision of information society services.

It is possible that, following the request for data deletion, Iepan Dorela may anonymize this data (thereby removing its personal character) and continue processing it for statistical purposes:

• the right to restrict processing to the extent that:
  • the person challenges the accuracy of the data, for a period that allows us to verify the correctness of the data;
  • processing is unlawful, and the data subject opposes the erasure of personal data, instead requesting the restriction of their use;
  • the operator no longer needs personal data for processing purposes, but the data subject requests them for the establishment, exercise, or defense of a legal claim; or
  • the data subject has objected to processing (other than direct marketing), for the period while it is verified whether the legitimate interests of the operator prevail over those of the data subject.
• the right to data portability, namely (i) the right to receive personal data in a structured, commonly used, and machine-readable format, and (ii) the right for this data to be transmitted by Iepan Dorela to another data controller, to the extent that the conditions provided by law are met;
• the right to object – regarding processing activities, it can be exercised by submitting a request as indicated below;
  • at any time, for reasons related to the particular situation in which the data subject finds themselves, for the data concerning them to be processed based on the legitimate interest of Iepan Dorela or based on public interest, except where Iepan Dorela can demonstrate legitimate and compelling reasons that justify the processing and that override the interests, rights, and freedoms of the data subject, or if the purpose is to establish, exercise, or defend a legal claim;
  • at any time, free of charge and without justification, for the data concerning them to be processed for direct marketing purposes.
• the right to withdraw your consent at any time, where processing is based on consent;
• the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them;
• the right to lodge a complaint with the supervisory authority: in Italy, the Garante per la protezione dei dati personali (garanteprivacy.it), or with the competent courts, to the extent deemed necessary.
