The Parties<\/h3>\n<p><strong>Provider:<\/strong> IEPAN DORELA, with registered office in Pozzuolo del Friuli (UD), Via Della Statua no. 13, Italy, VAT no. (P. IVA) 03186220301, e-mail: contact@dorelaiepan.com, hereinafter \u201cthe Provider\u201d.<\/p>\n<p><strong>Client:<\/strong> the person whose details are entered below, hereinafter \u201cthe Client\u201d.<\/p>\n<table border=\"1\" cellpadding=\"8\" style=\"border-collapse: collapse; width: 100%;\"><tr><th>Client details<\/th><th><\/th><\/tr><tr><td>Full name<\/td><td><\/td><\/tr><tr><td>Address (street, city, postal code, country)<\/td><td><\/td><\/tr><tr><td>E-mail<\/td><td><\/td><\/tr><tr><td>Phone<\/td><td><\/td><\/tr><tr><td>Date of the agreement<\/td><td><\/td><\/tr><\/table>\n<p>The Provider and the Client are together referred to as \u201cthe Parties\u201d. This agreement applies to the services described in section 2.<\/p>\n<h3 id=\"c2\">2. Subject of the agreement<\/h3>\n<p>2.1. The Provider offers the Client personal development and emotional well-being services, from the list below (only what was ordered applies):<\/p>\n<ul><li>individual sessions of emotional release and energy healing (Emotion Code\u00ae, Body Code\u00ae, Belief Code\u00ae, EFT, Matrix Reimprinting);<\/li><li>coaching sessions;<\/li><li>programs (for example the 28-day ones), workshops or retreats, to which the conditions of the specific offer also apply.<\/li><\/ul>\n<p>2.2. The services take place online (video or phone), remotely without the Client\u2019s presence (as with Emotion Code sessions), or in person, as ordered.<\/p>\n<p>2.3. Nature of the services and important notice<\/h3>\n<p>3.1. The Provider\u2019s services are personal development and emotional and energetic well-being services. They are not a medical act, psychotherapy, diagnosis or treatment, and they do not replace the consultation, treatment or medication recommended by a doctor or psychologist.<\/p>\n<p>3.2. The Provider does not diagnose, treat or prescribe, and does not recommend stopping or changing any medical treatment. The Client continues treatments and medical check-ups as indicated.<\/p>\n<p>3.3. The Provider does not guarantee any result. Effects differ from person to person, and the Provider\u2019s obligation is one of means (providing the service with diligence and professionalism), not of result.<\/p>\n<p>3.4. If the Client has a medical or mental health condition, or is going through a crisis, the Client is encouraged to contact a doctor or psychologist. In an emergency, the Client should call the emergency number 112.<\/p>\n<p>3.5. The Client takes part of their own free will and acknowledges having understood the nature of the services described in this section.<\/p>\n<h3 id=\"c4\">4. Booking, duration and conduct<\/h3>\n<p>4.1. Booking is made through the booking platform UseAce, e-mail or WhatsApp, and the date and time are confirmed in writing.<\/p>\n<p>4.2. The duration of a session is 30, 45 or 60 minutes, as stated in the offer.<\/p>\n<p>4.3. The Client connects or arrives at the agreed time. If the Client is late, the session ends at the planned time.<\/p>\n<p>4.4. For online sessions, the Client ensures a stable connection and a quiet place free from interruptions.<\/p>\n<p>4.5. For remote sessions without the Client\u2019s presence, the Provider sends, after the session, explanations about the process carried out and the results obtained.<\/p>\n<h3 id=\"c5\">5. Price, payment and invoicing<\/h3>\n<p>5.1. The price of the services is the one in section 2.3 and is expressed in EUR.<\/p>\n<p>5.2. Payment is made in advance, before the first session, by card, PayPal or bank transfer. For bank transfers, the Client sends proof of payment to contact@dorelaiepan.com.<\/p>\n<p>5.3. Prices are final: the Provider is not a VAT payer and does not charge VAT. The invoice states the legal basis for not applying VAT.<\/p>\n<p>5.4. The invoice is issued in electronic format and sent to the Client\u2019s e-mail address. The Client provides the data needed for invoicing.<\/p>\n<p>5.5. Until the price is received in full, the Provider may postpone the provision of the services.<\/p>\n<p>5.6. Amounts paid are refunded only in the cases provided for in sections 6, 7 and 10.<\/p>\n<h3 id=\"c6\">6. Cancellation and rescheduling<\/h3>\n<p>6.1. The Client may cancel or reschedule a session by written message to the Provider at least <strong>48 hours<\/strong> before the scheduled time. In that case, the session is rescheduled at no extra cost, within a maximum of 30 days.<\/p>\n<p>6.2. Sessions not cancelled at least 48 hours in advance are considered carried out.<\/p>\n<p>6.3. For sessions cancelled with less than 48 hours\u2019 notice, the Provider carries out a remote session using the Emotion Code method and, after the session, gives the Client details about the process and the results obtained. The session is considered carried out.<\/p>\n<p>6.4. If the Provider cancels a session (illness, force majeure or any other reason), the Provider reschedules it by agreement with the Client or, at the Client\u2019s request, refunds the price of the session not carried out within at most 14 days.<\/p>\n<h3 id=\"c7\">7. Right of withdrawal (consumers)<\/h3>\n<p>7.1. If the Client is a consumer (a natural person acting outside their trade or profession), the Client has the right to withdraw from the agreement within 14 calendar days of its conclusion, without giving any reason, by written notice sent to contact@dorelaiepan.com.<\/p>\n<p>7.2. If the Client expressly asks for the services to start before the 14 days expire and later withdraws, the Client will pay an amount proportionate to the services provided up to the time of the notice.<\/p>\n<p>7.3. After a service has been fully performed, the right of withdrawal is lost if performance began with the Client\u2019s prior express consent and the Client confirmed being aware of losing the right of withdrawal once the service is fully performed.<\/p>\n<p>7.4. For digital content delivered immediately (access to audio, video, applications or recorded courses), the right of withdrawal is lost once delivery begins, if the Client gave express consent and confirmed it.<\/p>\n<p>7.5. In case of a valid withdrawal, the Provider refunds the amounts due within at most 14 days of receiving the notice, using the same payment method as the Client.<\/p>\n<p>7.6. The express consent and confirmation in points 7.2\u20137.4 are given by ticking the relevant box in section 12.<\/p>\n<h3 id=\"c8\">8. Obligations of the Parties<\/h3>\n<p><strong>The Provider undertakes:<\/strong><\/p><ul><li>to provide the services professionally, in good faith and according to the booking;<\/li><li>to explain the methods used to the Client and not to promise cures or results;<\/li><li>to keep the information received confidential (section 9);<\/li><li>to issue the invoice for the amounts received.<\/li><\/ul>\n<p><strong>The Client undertakes:<\/strong><\/p><ul><li>to provide correct and complete data;<\/li><li>to inform the Provider of any health aspect the Client considers relevant to the sessions;<\/li><li>to be available at the agreed date and time and to pay the price on time;<\/li><li>to behave respectfully towards the Provider and not to record the sessions without the Provider\u2019s written consent.<\/li><\/ul>\n<p><strong>Client declarations.<\/strong> By accepting the agreement, the Client declares that:<\/p><ul><li>they are over 18 years old;<\/li><li>they understand that the services do not replace medical or psychological treatment (section 3);<\/li><li>they will not stop or change their medical treatment on the basis of the sessions;<\/li><li>they take part of their own free will.<\/li><\/ul>\n<h3 id=\"c9\">9. Confidentiality and personal data<\/h3>\n<p>9.1. The Provider keeps confidential the information the Client shares in sessions. The exceptions are legal obligations and situations where there is a serious and imminent danger to the life of the Client or of other people.<\/p>\n<p>9.2. The Client\u2019s personal data is processed by the Provider to conclude and perform the agreement, for invoicing and legal obligations (including keeping accounting records for the period required by law) and, only if the Client has consented, for marketing communications.<\/p>\n<p>9.3. Information about the Client\u2019s health is special-category data. The Provider processes it only on the basis of the Client\u2019s explicit consent, given by ticking the box in section 12, and only to carry out the sessions. The Client may withdraw consent at any time, without affecting the lawfulness of the processing carried out before.<\/p>\n<p>9.4. The Client has the rights provided by data protection law (access, rectification, erasure, restriction, portability, objection) and may lodge a complaint with the supervisory authority. Details are in the <a href=\"https:\/\/dorelaiepan.com\/privacy-policy\/\">Privacy Policy<\/a>. Contact to exercise these rights: contact@dorelaiepan.com.<\/p>\n<p>9.5. Sessions are not audio- or video-recorded without the written consent of both Parties. The Client\u2019s testimonials are used publicly only with separate written consent.<\/p>\n<h3 id=\"c10\">10. Intellectual property, liability, force majeure and termination<\/h3>\n<p>10.1. The materials received by the Client (documents, audio, video, exercises, workbooks, access to applications) remain the property of the Provider. The Client may use them for personal purposes only and does not copy, distribute or resell them.<\/p>\n<p>10.2. The Provider is liable for providing the services with diligence. The Provider is not liable for results not obtained, for decisions the Client takes alone, or for failure to follow medical advice. To the extent permitted by law, the Provider\u2019s liability is limited to the amount paid by the Client for the service concerned. This limit does not apply in case of wilful misconduct, gross negligence or personal injury and does not affect consumers\u2019 mandatory rights.<\/p>\n<p>10.3. Neither Party is liable for failing to perform its obligations if this is due to force majeure. If the event lasts more than 15 days, either Party may terminate the agreement by notice, and the Provider refunds the price of the services not provided.<\/p>\n<p>10.4. The agreement ends when the services have been fully provided, by agreement of the Parties, or by written notice in the cases provided by law.<\/p>\n<p>10.5. The Provider may end the collaboration, by written notice, in case of non-payment or abusive behaviour by the Client, refunding the price of the sessions not carried out.<\/p>\n<h3 id=\"c11\">11. Governing law, disputes and final provisions<\/h3>\n<p>11.1. The agreement is governed by Italian law. A consumer Client residing in another EU Member State keeps the protection of the mandatory provisions of the law of their country of residence.<\/p>\n<p>11.2. Complaints are sent in writing to contact@dorelaiepan.com, and the Provider replies within at most 30 days. The Parties first try to settle any dispute amicably.<\/p>\n<p>11.3. If an amicable solution is not possible, the dispute is decided by the competent court of Udine (Italy), without prejudice to the consumer\u2019s right to bring proceedings before the court of their place of residence, where mandatory law grants this right. The consumer may also use the out-of-court dispute resolution mechanisms provided by law (in Italy, for example, consumer mediation and alternative dispute resolution bodies).<\/p>\n<p>11.4. The agreement includes the <a href=\"https:\/\/dorelaiepan.com\/terms-and-conditions\/\">Terms and Conditions<\/a> and the <a href=\"https:\/\/dorelaiepan.com\/privacy-policy\/\">Privacy Policy<\/a> of dorelaiepan.com. In case of differences, the signed agreement prevails.<\/p>\n<p>11.5. Amendments are made only in writing, with the agreement of both Parties. If a clause is void, the others remain valid.<\/p>\n<p>11.6. If translations of the agreement exist, in case of differences the Romanian version prevails.<\/p>\n<p>11.7. Electronic acceptance (signature, ticking the boxes in section 12, or written confirmation by e-mail) has the same value as a signature on paper.<\/p>\n<h3 id=\"c12\">12.
